1. Who We Are
DisclosureCheck™ ("DisclosureCheck," "we," "us," or "our") is an independent property research and information service operating at disclosurecheckfl.com. We are not a licensed real estate broker, agent, appraiser, inspector, or attorney. We are a research aggregation service that compiles publicly available information and presents it in a structured, attributed format.
2. What Our Service Is
DisclosureCheck™ provides written property intelligence reports ("Reports") based on publicly available records including but not limited to: county property records, FEMA flood maps, state permit databases, published crime statistics, school performance data, MLS listing information, and other publicly accessible sources.
Our Reports are:
- Informational research documents based on publicly available data
- Attributed to their sources with verification portals provided
- Intended to supplement — not replace — professional inspections, appraisals, title searches, and legal counsel
- Current as of the date of generation; real estate data changes and we make no warranty of ongoing accuracy
3. What Our Service Is Not
DisclosureCheck™ Reports are not:
- Legal advice or a legal opinion of any kind
- Real estate advice, a comparative market analysis (CMA), or a broker price opinion
- A licensed real estate appraisal
- A home inspection or engineering report
- A title search or title insurance product
- A guarantee of property condition, value, or suitability for any purpose
4. Payment Terms
One fee covers one property. Each Report order covers a single property address. Additional properties require separate orders at the applicable package price. Prices are displayed at disclosurecheckfl.com/order.html and are subject to change without notice. All payments are processed securely via Stripe. We do not store credit card information.
All sales are final. Due to the research-based nature of our service, we do not offer refunds once a Report has been generated and delivered. If your Report was not delivered within the stated timeframe due to a system error on our part, contact support@disclosurecheckfl.com and we will resolve the issue promptly.
5. Accuracy and Limitations
We make reasonable efforts to ensure the accuracy of information presented in our Reports. However:
- Public records contain errors and may be incomplete or out of date
- MLS and listing data changes frequently and may not reflect current status at time of delivery
- Flood zone designations are based on published FEMA data and must be verified at official government portals before any financial decision
- School assignment boundaries must be verified with the relevant school district before relying on school information
- Crime data reflects neighborhood-level statistics from public FBI records and is not property-specific
You assume full responsibility for independently verifying all information in your Report before making any purchase, offer, or financial decision.
6. Limitation of Liability
To the maximum extent permitted by applicable law, DisclosureCheck™ and its owners, operators, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of our Reports or your reliance on information contained therein, including but not limited to damages arising from real estate purchase decisions, financial loss, or errors in publicly available data we relied upon.
Our total liability to you for any claim arising from your use of our service shall not exceed the amount you paid for the Report giving rise to the claim.
7. Intellectual Property
Reports are generated for your personal use in connection with a specific property transaction. You may share your Report with your real estate agent, attorney, lender, or other transaction professionals. You may not resell, republish, or commercially distribute Reports without written permission.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law provisions. Any dispute arising from these Terms or your use of our service shall be resolved in the courts of the State of Florida.
9. Changes to These Terms
We reserve the right to update these Terms at any time. The current version will always be available at disclosurecheckfl.com/terms.html. Continued use of our service after changes constitutes acceptance of the updated Terms.
